1. Acceptance of Terms

By accessing or using BagPortrait ("the Service"), operated by HLMT Ltd ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

These terms constitute a legally binding agreement between you and HLMT Ltd regarding your use of the Service.

2. Service Description

BagPortrait is an AI-powered fashion visualization tool that allows you to:

• Upload a photo of yourself
• Upload or select a designer bag or accessory image
• Generate AI-created images showing you with the accessory
• Download and share the generated images

Privacy-First Approach: We do not store your uploaded photos or generated images. All image processing occurs in memory and images are immediately discarded after generation.

3. Eligibility

To use BagPortrait, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding agreements
• Have the right to use any images you upload (either your own photos or images you have permission to use)
• Not be prohibited from using the Service under applicable laws

4. Accounts

When you create an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We use secure authentication provided by Clerk. You may sign in using email magic links or social login providers.

5. Acceptable Use

You agree NOT to:

• Upload images containing illegal content
• Upload images of minors or vulnerable individuals
• Upload images you don't have rights to use
• Attempt to generate harmful, deceptive, or inappropriate content
• Use the Service for harassment or to create non-consensual imagery
• Circumvent usage limits or security measures
• Reverse engineer or copy the Service
• Use automated systems to access the Service without permission

We reserve the right to refuse service and terminate accounts that violate these guidelines.

6. Intellectual Property

Your Content: You retain all rights to the photos you upload. We do not claim ownership of your images.

Generated Images: Images generated by the Service are yours to use for personal and commercial purposes, subject to these terms and any applicable third-party rights.

Our Service: The BagPortrait name, logo, website design, and underlying technology remain the property of HLMT Ltd. You may not copy, modify, or redistribute our Service without permission.

7. AI-Generated Content

BagPortrait uses Google's Gemini AI to generate images. You acknowledge that:

• AI-generated results may vary in quality and accuracy
• The AI may occasionally produce unexpected or imperfect results
• Generated images include a digital watermark (SynthID) as required by Google
• Certain content may be rejected by the AI's safety filters

We provide guidance and suggestions to help you achieve better results, but cannot guarantee specific outcomes.

8. Payments & Subscriptions

Free Trial: New users receive a limited number of free generations to try the Service.

Subscriptions: Paid plans provide monthly generation allowances. Subscriptions automatically renew at the end of each billing period until cancelled.

Auto-Renewal: By subscribing, you authorize us to charge your payment method on a recurring basis. You will be notified before each renewal.

Cancellation: You may cancel your subscription at any time through your account settings or the Stripe billing portal. Access continues until the end of your current billing period.

Price Changes: We may change subscription prices with 30 days' notice. Continuing to use the Service after a price change constitutes acceptance.

9. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

To the maximum extent permitted by law, HLMT Ltd shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Service interruptions or errors
• Actions of third-party services (Stripe, Clerk, Google)

Our total liability shall not exceed the amount you paid us in the 12 months preceding any claim.

10. Termination

By You: You may delete your account at any time through your profile settings. This will cancel any active subscriptions and remove your data.

By Us: We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or for any other reason at our discretion. We will attempt to notify you before termination where practical.

11. Changes to Terms

We may update these terms from time to time. Significant changes will be communicated via email or prominent notice on the Service. Continued use after changes constitutes acceptance. If you disagree with changes, you should stop using the Service.

12. Governing Law

These terms are governed by the laws of the United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
